Welcome to fullgazz. Please read these Terms of Use ("Terms") carefully before using the fullgazz website and coaching platform (the "Service"), operated by fullgazz ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Medical Disclaimer (Crucial)
fullgazz is not a medical device and does not provide medical advice.
- Consult a Doctor: The Service, including data analysis, AI-generated summaries, and coaching tools, is for informational and educational purposes only. You should always consult with a physician or other qualified healthcare provider before starting any new training program.
- Risk of Injury: By using the Service, you acknowledge that athletic activities (running, cycling, swimming, etc.) carry inherent risks of injury or death. You voluntarily assume full responsibility for all risks associated with your use of the Service.
- Not a Diagnosis: Never disregard professional medical advice or delay in seeking it because of something you have read on the Service.
2. Accounts and Security
- Account Creation: To use certain features, you must register for an account. You agree to provide accurate and complete information.
- Security: You are responsible for safeguarding the password (or authentication method) you use to access the Service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Use of Third-Party Data
Our Service integrates with third-party providers ("Source Data Providers") such as Garmin Connect, Suunto, COROS, Polar, and Intervals.icu.
- Authorization: By syncing these accounts, you authorize us to access and display your activity data.
- Availability: We do not guarantee the permanent availability of these integrations. If a Source Data Provider changes their API or restricts access, we may cease providing features that rely on that data without entitling you to a refund.
- Accuracy: We rely on the data provided by these third parties. We are not responsible for inaccuracies in GPS, heart rate, or power data recorded by your devices.
4. AI and Automated Insights
The Service may use Artificial Intelligence (AI) to provide training summaries or insights.
- No Guarantee: AI generation is experimental and may produce inaccurate or "hallucinated" results. You should not rely solely on AI analysis for critical training decisions.
- Coach Review: If you work with a coach, AI insights are intended to support, not replace, their professional judgment.
5. Intellectual Property
The Service and its original content (excluding user-generated workout data), features, and functionality are and will remain the exclusive property of fullgazz. The Service is protected by copyright and trademark laws.
6. User Conduct
You agree not to use the Service to:
- Violate any national or international law.
- Harass, abuse, or harm another person (including coaches or other athletes).
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall fullgazz, its founders, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Physical injury or death resulting from your training.
- Loss of profits, data, use, or goodwill.
- Service interruptions or data loss due to server failures or third-party API issues.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, whether express or implied, that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors will be corrected.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Lithuania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Vilnius, Lithuania.
11. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
